Investment Arbitration Award Enforcement

In investment arbitrations, securing a favorable award is not always enough. When the debtor is a sovereign entity, it is common for several of its assets to be unavailable for execution. But what if the losing party is a public company, or one controlled by a sovereign entity? What is the international scenario for the execution of investment arbitration awards?
At the request of The Law Reviews UK, Luiz Olavo Baptista, Adriane Nakagawa Baptista and Caique Queiroz explore this complex and controversial issue, which emerges at the intersection between law and international relations, examining the legal framework for the enforcement of arbitration awards in France, the United Kingdom, Venezuela, Russia, Argentina and the United States.

Monograph contest

In 2018, we organized the 1st Atelier Jurídico Monograph Contest. The judging committee, composed of Lise de Almeida, Adriana Pucci and Elizabeth Accioly, picked Gabriel Caetano Visconti and José Victor Palazzi Zakia’s work “Estudo Sobre a Coerência na Prática Arbitral” (Study on Consistency in Arbitral Practice).
The main theme of the competition was “Arbitration and the Duty of Consistency: An Invitation for Reflection”, on which participants should produce unpublished and written material especially for the occasion.
The promotion of the study of law was the main goal of the contest, and is one of the Atelier Jurídico’s foundations.
